Interpretation


"DeshCall", "we", "us", "our", or similar terms refer to DeshCall or VoicePipes both of which are trading names of Adding Value to Business Pty Ltd, a New South Wales registered company.


"You", "your", "customer", or similar terms refer to the person in which DeshCall is providing services to, or the person which is applying for service from DeshCall.


"Product", "Service", or similar terms refer to any thing that DeshCall provides to you.


Commencement of Agreement


This agreement (other than clause 4.1) is in effect from the date you join DeshCall, and is not necessarily terminated by ending your services with us.


These terms


These terms and conditions apply to all DeshCall customers, whether business, residential, or wholesale; and are subject to change without notice. A copy of our latest terms and conditions will always be available on  HYPERLINK "http://www.deshcall.com.au" www.deshcall.com.au, or are available by calling us on 1300-306-487.


Additional terms and conditions may apply to some of our services. If so, we will tell you what those terms are. If there is any conflict between these terms and any additional terms, the additional terms will prevail.


These terms are subject to the laws of Australia. 


Our services


We have the right to refuse service to any person, and nothing in these terms and conditions shall apply (except for this clause) unless we accept your application for service.


We will make all reasonable endeavours to provide you with a stable and reliable service. Whilst we can not guarantee one hundred percent up time, we strive to provide the best possible service. To honour this commitment to our customers, we will provide a full refund if a call is terminated for any reason within the first thirty (30) seconds.


If a call is terminated after the first thirty (30) seconds, the customer shall be liable for the full cost of the call, at the per-minute or promotional rate that applies at the time the call was placed.


DeshCall has the right to suspend or restrict service at any time and without notice if:


We consider it necessary to protect and maintain the security or stability of our network; or


We believe that you have breached any of our terms and conditions, including but not limited to non payment.




Charges


You are responsible for all charges on your account, and the security of any passwords or codes are your responsibility. DeshCall will not be held responsible for any breach of security on our network.


All charges to DeshCall are to be prepaid unless otherwise stated. All payments are final, and account credit is not redeemable for cash.


If we agree to provide credit to you, all charges must be paid in full within ten (10) working days unless otherwise stated. Failing to pay for our services may result in legal action being taken or the account being transferred to a debt collection agency. You will be responsible for any collection fees incurred, and a penalty fee may also apply.


All pricing and charges include Australian GST. 


Using our services


You must not use our services in a way which:


breaks any Australian law;

infringes anyone's legal rights;

damages the security or stability of our network; or

is malicious, obscene or offensive. 


You must not resell our services to any other person unless expressly permitted by DeshCall. Activities such as auto-dialling, continuous call forwarding, telemarketing, call centres, fax or email broadcasting are strictly prohibited unless otherwise stated.


You must comply with any reasonable restrictions or rules we apply to the use of our services.


We may suspend, modify, or remove any service as we deem fit. We will try to give you as much notice as possible, and move you to the closest replacement plan or service.


You must ensure that all information you provide to us is correct. If your contact details change at any time, you must notify us as soon as possible. Incorrect contact details can not be used as a defence for non payment of services.


You agree that we can act on any verbal request that you provide to us, and that you agree to any conditions that apply to such request.


Ending this agreement


If you wish to terminate this agreement, you must supply at least 30 days written notice. DeshCall will terminate all services provided to you upon termination of this agreement.


DeshCall may terminate this agreement by providing 30 days written notice to you. This does not limit DeshCall's ability to suspend services without notice as disclosed in clause 4.4.
